By accessing or using HyperMemory ("the Service"), operated by RunStack AI ("we," "us," or "our"), including the website at hypermemory.io, the application at app.hypermemory.io, the MCP server, CLI, and REST API, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
HyperMemory is a persistent knowledge graph memory service for AI agents. It provides tools for storing, retrieving, and managing structured memory data through MCP (Model Context Protocol), a REST API, and a command-line interface.
To use the Service, you must create an account via OAuth authentication (GitHub, Google, or email/password through Supabase). You are responsible for maintaining the security of your account credentials, API keys, and access tokens. You agree to notify us immediately of any unauthorised use of your account.
You must be at least 16 years of age to use the Service. By creating an account, you represent that you meet this requirement.
You retain full ownership of all data you store through the Service, including memory nodes, edges, hyperedges, uploaded files, and any associated metadata. We claim no intellectual property rights over your content.
By using the Service, you grant us a limited license to store, process, transmit, and display your data solely as necessary to provide and improve the Service. This license terminates when you delete your data or close your account.
We do not use your data to train, fine-tune, or improve any machine learning or AI model. Your data is used exclusively to operate the Service for your benefit.
The Service is offered across multiple tiers: Free, Basic, Pro, Business, and Enterprise. Each tier has specific query limits, graph limits, and features as described on our pricing page.
Paid plans are billed monthly or annually in advance via Stripe. Annual billing provides a discount as displayed at time of purchase. All prices are in US dollars unless otherwise stated.
Paid plans (Basic, Pro, Business) support query overages beyond the included monthly limit. Overages are billed at the rate specified for your tier. The Free tier enforces a hard limit with no overages.
You may upgrade your plan at any time; upgrades take effect immediately. Downgrades take effect at the start of your next billing cycle. No partial refunds are issued for unused time on the current billing period.
You may cancel your subscription at any time through your account settings. Upon cancellation, your plan remains active until the end of the current billing period, after which your account reverts to the Free tier. Your data is not deleted upon downgrade; however, features and limits will be adjusted to match the Free tier.

API keys grant programmatic access to your memory graphs. Keys are bound to specific graphs and carry a defined scope (owner or member). You are solely responsible for securing your API keys. Treat them as passwords — do not commit them to version control, share them publicly, or embed them in client-side code.
We are not responsible for any damage or data loss resulting from compromised API keys.
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. Planned maintenance will be communicated in advance where possible.
SLA guarantees are available for Pro (99.5%), Business (99.9%), and Enterprise (99.95%) plans as described on our pricing page. The Free and Basic tiers are provided on a best-effort basis.
The Service, including its software, design, documentation, and branding, is the property of RunStack AI and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand name without prior written permission.
To the maximum extent permitted by applicable law, HyperMemory and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
Our total aggregate liability for any claims relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless RunStack AI and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your use of the Service or your violation of these Terms.
We may suspend or terminate your access to the Service at any time if you breach these Terms, engage in abusive behaviour, or fail to pay outstanding charges. Upon termination, your right to use the Service ceases immediately.
You may request deletion of your account and all associated data at any time by contacting support@hypermemory.io.
We reserve the right to modify these Terms at any time. Material changes will be communicated by updating this page and the "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of the European Union and the applicable member state where RunStack AI is established. Any disputes shall be resolved in the competent courts of that jurisdiction.
